Terms of Service

Kiez ("we", "us") is a marketplace that matches Berlin businesses with local residents who post about their neighborhood on Instagram.

By creating an account or using Kiez ("the Service") you agree to these Terms of Service. If you don't agree, please don't use the Service.

You must:

• Be at least 18 years old
• Be legally able to enter into a binding agreement
• Use the Service only for lawful purposes

Connectors must have a public Instagram account with at least 500 followers and a real Berlin residence. Businesses must operate a physical venue in Berlin.

Accounts are created via a magic link sent to your email. Each email is associated with one role (business or connector). You are responsible for keeping access to your inbox secure.

The platform facilitates a barter: a business offers a perk (a meal, a discount, a sample) in exchange for the connector publishing one Instagram post that meets the campaign requirements (mention, disclosure hashtag, campaign hashtag, format, posted within the window).

German law disclosure. Posts published in exchange for a perk must include #werbung (or#anzeige). Kiez prefills this on every campaign and verifies its presence before marking the post complete. Connectors are responsible for following the disclosure when they publish.

No cash exchange. Kiez does not facilitate monetary payment between businesses and connectors. Any side arrangement is between the parties and outside the scope of these Terms.

When a business approves a connector, Kiez generates a single-use redemption code that expires at the end of the campaign window. The connector presents the code at the venue, the business confirms it on the redemption page, and the connector posts on Instagram within 7 days of redemption.

Kiez fetches the submitted post via Apify and verifies it matches the campaign requirements. Verified posts are credited to the campaign's outcome card. Unverified posts can be re-submitted with a corrected URL.

You agree not to:

• Use the Service for unlawful purposes
• Misrepresent your identity, business, or audience
• Use bots, fake followers, or engagement-fraud services to inflate connector reach
• Submit a redemption code you didn't receive or a post that isn't yours
• Skip the disclosure hashtag on a perk-based post
• Attempt unauthorized access to Kiez systems or other users

Violation may result in suspension or removal from the Service. We may also report serious violations to relevant authorities.

Kiez is free during the soft launch. Pricing for businesses will be introduced once the platform matures, with notice. Connectors will not be charged.

Both sides rate each other after a completed campaign. Ratings feed each profile's reputation, which is shown to the other side at decision points. We may remove ratings that appear to violate these Terms or applicable law.

Kiez owns the platform, its branding, and its source code. You retain ownership of content you create (campaign copy, profile information, Instagram posts). You grant us a limited license to process your content as needed to provide the Service.

The Service is provided "as is" and "as available". We make no warranties about uptime, accuracy, or fitness for any specific purpose.

To the maximum extent permitted by law, we are not liable for indirect or consequential damages, lost revenue, or reliance on the Service. Our total liability is limited to the amount you have paid us in the 12 months preceding the claim (€0 during the soft launch).

You may delete your account at any time. We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the Service.

These Terms are governed by the laws of Germany, excluding conflict-of-law rules. Jurisdiction shall be the courts of Berlin, unless mandatory consumer-protection law applies.

We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use after a change means you accept the new Terms.
